Overview of a Traffic School
What is the cost of Traffic School?
The court usually charges a $52 admin fee to process your traffic school paperwork. Additionally, online traffic school usually costs ~$20.
Finally, you should usually request a copy of your driving record from the DMV 2-3 months after the completion of Traffic School to make sure no-one messed up and the point was actually removed.
All in, completing Traffic School will cost you another ~$75 on to your fine.
What are the eligibility requirements for Traffic School?
Is Traffic School eligibility lost if the ticket is contested?
No. Entering a 'not guilty' plea or losing at trial does NOT make you ineligible for Traffic School.
This was laid out in the California Vehicle Code (Section ) and affirmed in People v Wozniak.
California Rule of Court 4.104(c)(3):
A defendant who is otherwise eligible for traffic violator school is not made ineligible by entering a plea other than guilty or by exercising his or her right to trial. A traffic violator school request must be considered based on the individual circumstances of the specific case. The court is not required to state on the record a reason for granting or denying a traffic violator school request.
However, it must be confirmed that the court has offered traffic school before you go to trial.
